The mission of the Neighborhood Services division is to administer and enforce minimum building and property maintenance standards, in order to safeguard the health, safety and general welfare of the occupants of buildings and the surrounding premises. Those minimum standards and procedures are defined by: various model codes that are periodically reviewed and adopted; by provisions within the Municipal Code; and by applicable State of Oklahoma statutes. Code Enforcement is comprised of two separate divisions, Building Services
and Property Inspections
. Building Services provides permitting and inspections of construction within the City’s jurisdiction. Property Inspections provides the mechanism for abatement of nuisance conditions. These divisions are staffed by inspectors who are licensed by the State of Oklahoma and the Oklahoma Code Enforcement Association. The codes they enforce are different, but in many cases they must work together none the less. Correction of property deficiencies, as determined by property inspectors, may require repair/reconstruction, and that work must meet those minimum standards that are enforced by building inspectors.
The Building Services Division of Neighborhood Services is responsible for permitting and inspecting new construction projects to determine compliance with currently adopted building codes
to Persons who wish to construct a building or structure must provide details of the project so that City staff can determine that the plans comply with applicable building and zoning regulations. The application process is relatively simple. With the appropriate information in hand, a permit can be issued quickly, sometimes on the spot. Commercial building permits generally require more detailed plans and specifications, therefore dictating a more detailed plan review. Property Inspections/Nuisance Abatement
The Property Inspections division of Neighborhood Services is responsible for enforcing the provisions of the International Property Maintenance Code, and of the Public Nuisance section of the Municipal Code. Of note is the fact that the Code Enforcement department was recently realigned to allow more emphasis on nuisance abatement activities.
Administrative and Criminal Process
The process of abating nuisances can be pursued either administratively or criminally, depending on whether or not the alleged offender is a current Ponca City resident. The administrative process is commonly used to abate nuisances where the owner is deceased, cannot be found, or lives out of state. After sending yout a formal notice, a hearing is scheduled to determine if the alledged Code violation constitutes a public nuisance. Should it be determined that a nuisance does exist, it can be ordered that the property be cleaned up and the cost can be levied as a lien against the property. The downside to this is that the City must budget for the costs fo removing nuisances;many times these costs are never repaid.
The second process of abating nuisances is pursuing criminal charges against the alleged offender. Again, formal notice is provided by mail, and a grace period is given in which to correct the nuisance. Failure to do so results in the issuance of a citation and a formal date in front of the Municipal Judge. Upon conviction the offender may be fined and even placed in jail if necessary.
